kentma1 I see you’ve been troll-feeding in cola – a brief interlude, I hope :-) Oct 21 10:30
schestowitz Watch Novell’s PR (lie) department on performance: http://www.novell.com/company/blogs/cmo/?p=119 Oct 21 10:30
schestowitz They are still spoon-fed by Microsoft, financially… to destroy Freedom. Oct 21 10:30
kentma1 Novell are clearly moving more and more towards a lock-in based trading model. Oct 21 10:31
schestowitz To make matters worse, they use some of that money to scoop up companies that will — in due time — help them fight freedom further, along with the convicted monopolist that calls Linux a “Cancer”: http://www.novell.com/company/blogs/cmo/?p=121 Oct 21 10:31
schestowitz How people can work for Novell… probably just desperation for a check while perfuming what they do for the Mighty Buck. Social issues? Naa… leave that aside for now. Oct 21 10:32
schestowitz kentma1: they add lock-in to GNU/Linux also. Oct 21 10:32
schestowitz About 90% of their business (revenue wise, IIRC) is proprietary and with all those patented things they have (and SLE) they just try to sell a ‘mixed source’ Linux. That’s why we should call it Ballnux and encourage people to avoid it. Oct 21 10:33
kentma1 a bad business all round.  I wonder just how sustainable it will be., though, but they clearly need to “walk slowly backwards” away from their proprietary revenue streams Oct 21 10:34
schestowitz In many ways, Novell is like Microsoft. Punching you in the crotch (“cut off air supply of [Red Hat|Netscape]“) and then buying flowers (“look! we give some source  code”). Oct 21 10:35
schestowitz It fools many people. Perens < http://slashdot.org/comments.pl?si… >: Oct 21 10:36
kentma1 desperately trying to stay in businesss, I suspect. Oct 21 10:36
schestowitz “I think mostly they’d like to dilute “Open Source” to mean any code with source code. This is important to them because it’s the rights connected to Open Source that scare Microsoft (and others). If you can call it Open Source when there isn’t even the right to compile the code, or to use the information you get from reading it, customers don’t have a reason to ask for it any longer.   Their publicity agencies are here Oct 21 10:36
schestowitz on Slashdot pumping that angle every day. “ Oct 21 10:36
schestowitz This leads me to suspecting BN has attracted some of those “publicity agencies” Perens is personally familiar with.  Many of them pose as “open source people”. Oct 21 10:37
kentma1 They’re well rehearsed.  We’ve seen them for years on cola, too, although the message has become rather more sophisticated over time. Oct 21 10:39
schestowitz In COLA I don’t quite see it. I can’t think of a Munchkin who sells the “Microsoft is your friend and open source fan” pitch. Oct 21 10:40
schestowitz Groklaw has them too… Microsoft lobbyists posing as “FOSS people” to gain credibility and then throw slime at ODF, Linux, Free software, RMS and so on. Oct 21 10:41
schestowitz http://fussnotes.typepad.com/plexnex/… “Interestingly, Labaton makes the point that the motivation to increase the freedom of the investment banks originated in the feeling that it was necessary in order to allow the American firms to compete in the new, flatter global arena. It seems we were heading down already.” Oct 21 10:52
schestowitz Paul Krill does an article abotu Ajax… so why is he even mentioning the enemy of Ajax (XAML binary mess)? “Silverlight itself is a very small plugin, about 4.6 megabytes,” Guthrie said.  < http://www.linuxworld.com.au/index… >. The Register is doing the same thing, giving Microsoft attention in unrelated articles. Oct 21 11:11

miti Roy, I believe Microsoft is a dangerous company for a democratic society. What can be done? Oct 21 11:26
schestowitz Regulation is too weak. Oct 21 11:27
schestowitz One option is making better products than them while avoiding the creation of “Another Microsoft”. Oct 21 11:28
miti I mean what be done in the EU? What can politicians do for us? Oct 21 11:29
schestowitz There is no proper democracy (to refer to your question). The corporations run the governments. Oct 21 11:30
schestowitz In a proper democracy, citizens elect representative to represent the voter’s need, as opposed to a minority of affluent executives. So one tipping point for Free software is the financial collapse. It encourages people to ask question about how corruption came about and allowed this to happen. Microsoft is just part of an issue that’s broader. Oct 21 11:32
miti I see Oct 21 11:33
miti Still I would be curious about actions, e.g. in the context of the upcoming elections Oct 21 11:33
schestowitz Take McCreecy for example (the policians you refer to). The guy just sold out in the interests of the Nancy Sinatra of the world — those who want to make money sitting in sunbeds all day. Oct 21 11:34
schestowitz The same guy seems to be pushing s/w patents in EU, on behalf of Microsoft. Oct 21 11:34
miti Soundcopyright.eu ?? Oct 21 11:34
schestowitz All of these are legal tools that obstruct regulation and attack Freedom. Oct 21 11:34
*schestowitz looks at site Oct 21 11:34
miti http://www.opensourceworldconference.com/streaming Oct 21 11:35
schestowitz Yes, that’s the domain (one among more). Oct 21 11:35
schestowitz Whoever you vote for, you get a ‘package’. You get a whole group, some of whom are cronies. Oct 21 11:36
schestowitz Timely example: vite Obama, get RIAA/MPAA cronyism through Biden, the potential Vice President. Oct 21 11:36
schestowitz So the solution won’t come through elections. If you look at GNU/Linux or Microsoft deep enough, you’ll probably go all the way up to the top to find the source of problems (e.g. Gates phoning presidents for OOXML support). Oct 21 11:37
miti Anyway, change is needed and I am looking at things to do. Oct 21 11:37
schestowitz Information helps. Oct 21 11:38
schestowitz If you can surpass the brainwash (example: “more patents = more innovation”), then you pressure the cronies. Oct 21 11:38
schestowitz If, as in the case of the OOXML corruption, you name people who are guilty and provide overwhelming proof, they run and hide, maybe even sacked. Oct 21 11:39

miti But there can be information overload. You cry fraud for good reasons and nothing happends Oct 21 11:50
miti you start to sound shrill although its all true Oct 21 11:50
schestowitz There are ways of presenting this neatly. Oct 21 11:51
schestowitz People do listen because they look for particular information, e.g. in search engines, and then find it. Oct 21 11:51
miti I am looking for action that kills their business. What would be most effectivee? Oct 21 11:54
schestowitz Several things (off the top of my head): Oct 21 11:56
schestowitz 1. Expose their corruption (there is plenty) to get them in trouble Oct 21 11:57
schestowitz 2. Educate people about freedom, digital in particular. Many are deceived just by cost. Oct 21 11:57
schestowitz 3. Explain to Microsoft people why the things they do are wrong. Employee retention at Microsoft is already growing poor. Oct 21 11:58
schestowitz 4. Help promote Microsoft competitors that stay faithful to freedom. Communities too are worth improving because corporations have their own agenda and shareholder. Oct 21 11:58
miti http://www.youtube.com/watch?v=RGtk3PMfU8s   funny video about the McCain connection Oct 21 11:59
schestowitz There are many. Oct 21 11:59
schestowitz Apart from the ‘advisors’ McCain has. Oct 21 11:59
miti But as Obama will win who is Mr. Evil? Biden? Oct 21 12:00
schestowitz http://boycottnovell.com/2008/0… Oct 21 12:01
schestowitz The comment at the very bottom here < http://boycottnovell.com/2008/08/26/pa… > also explains the McCain-Microsoft connection. Oct 21 12:02

twitter Link to Dennis article?  I have one from 5/16 Oct 21 22:11
schestowitz http://www.groklaw.net/article.php?s… Oct 21 22:11
schestowitz “Isn’t that hilarious? To be fair, those Wall Street dudes are likely under a lot of stress nowadays. If he needs a job, maybe he should write a column with “Paul Murphy”, who also comes up with his own histories on the birth of Linux.” Oct 21 22:12
twitter Oh yeah, I got that one. Oct 21 22:13
twitter It’s like a SCO echo.  Confusion put out once comes back many new and unexpected ways. Oct 21 22:14
schestowitz I was a victim of the MINIX lie. Oct 21 22:15
twitter M$ knows this and it’s one of the reasons they pollute the online world. Oct 21 22:15
schestowitz For years I thought Linux was derived from Minix. Oct 21 22:15
schestowitz It’s a Microsoft-derived lie rather… echoed many times, even in its conferences. Oct 21 22:15
twitter what did you think derived meant? Oct 21 22:16
schestowitz I use it loosely in this context… but I was talking about a fork. Oct 21 22:17
twitter Oh. Oct 21 22:18
schestowitz I read it somewhere… part of the ‘pollution trail’… disinfo. Oct 21 22:18
schestowitz The problem is that U unknowingly spread this lie further for at least a year. I thought it was true. So it’s an infectious broken telephone thing… Microsoft just needs to ‘plant’ and seed the lies. Oct 21 22:19
schestowitz I suspect that the anti-Chrome EULA FUD came from Microsoft as well. Oct 21 22:19
twitter Yes, that’s why they work so closely with journalists. Oct 21 22:19
schestowitz On the very same day it was announced I think the Ina Fried SHILL is the one that started spreading  (seeding) this attack. Oct 21 22:20
twitter I’m reading the Intel Ballnux article now.  RMS has said that Intel is an enemy of software freedom. Oct 21 22:20
schestowitz And knowing (with evidence) how Microsoft used O’Gara to sabotage the OSDL announcement (evidence in BN), it’s likely  that Microsoft intelligence knew about the announcement and did FUD homework Oct 21 22:20
twitter Yes, M$ plans it’s lies in advance. Oct 21 22:21
twitter That came out in the DRDOS case. Oct 21 22:21
schestowitz They also plan to sabotage the next Apple laptop announcement… just as they did with VMware’s event, Lotus (many years ago) and PS3 parties (launch parties in several countries) that management at Microsoft coordinated to sabotage systematically. Kids cried. Oct 21 22:21
schestowitz But don’t listen to my facts. Microsoft is a nice company. Yes. Shiny!! Yes. Oct 21 22:22
twitter They made sure Win3.1 would not work with DRDOS and planned to blame DR in newsgroups.  It worked perfectly. Oct 21 22:22
twitter Until their email was presented in court. Oct 21 22:23
schestowitz Yes Oct 21 22:23
schestowitz I have the evidence in BN too. Oct 21 22:23
schestowitz Have you seen it? Oct 21 22:23
twitter No.  The records have since been destroyed. Oct 21 22:23
twitter I’d like to see that. Oct 21 22:23
schestowitz Same with ODF plugins. Oct 21 22:23
schestowitz Search bn for dr-dos Oct 21 22:23

schestowitz Ick!! http://www.benkevan.com/blog/switching-from-… “In the past years the phrase Linux has been mis-represented as a full blown distribution and not it’s original meaning. Linux, actually derived from the “Linux Kernel”, which was originally written by Linus Torvald in the early 90’s. So it is important to not refer a distribution as Linux, but as a Linux Distribution.” Oct 21 23:06
schestowitz Ouch. “What is the best Desktop Environment? Much like Distributions.” Lots of disinfo out there. Oct 21 23:07

What Else is New

  1. Some US Patents' Quality is So Low That There's a Garden Clearance/Fire Sale

Rather than shoot worthless patents into orbit where they belong the Allied Security Trust (AST), collector of dubious patents, will try to sell them to gullible opportunists and patent trolls (even if the said patents would likely perish in courts)

  2. When Amplifying the Message of 'Global Innovation Index 2018' IP Watch Sounds Like WIPO and IP Watchdog (Watchtroll)

In addition to senatorial efforts and misleading debates about patents, we now contend with something called “Global Innovation Index 2018," whose purpose appears to be similar to the debunked Chamber of Commerce's rankings (quantifying everything in terms of patents)

  3. Erosion of Patent Justice in Europe With Kangaroo Courts and Low-Quality European Patents

The problematic combination of plaintiff-friendly courts (favouring the accuser, just like in Eastern Texas) and low-quality patents that should never have been granted

  4. Mafia Tactics in Team UPC and Battistelli's Circle

Mafia-like behaviour at the EPO and the team responsible for the Unified Patent Court (UPC); appointments of loyal friends and family members have become common (nepotism and exchange of favours), as have threats made towards critics, authorities, and the press

  5. Australia Says No to Software Patents

Rokt is now fighting the Australian patent office over its decision to reject software patents; Shelston IP, an Australian patent law firm (originally from Melbourne), already meddles a great deal in such policies/decisions, hoping to overturn them

  6. Links 19/7/2018: Krita 4.1.1, Qt Creator 4.7.0, and Microsoft-Led Lobby Against Android in EU

    Links for the day

  7. IAM is Pushing SEPs/FRAND Agenda for Patent Trolls and Monopolists That Fund IAM

The front group of patent trolls, IAM, sets up an echo chamber-type event, preceded by all the usual pro-FRAND propaganda

  8. “Trade Secrets” Litigation Rising in the Wake of TC Heartland, Alice, Oil States and Other Patent-Minimising Decisions

Litigation strategies are evolving in the wake of top-level decisions that rule out software patents, restrict venue shifting, and facilitate invalidation of patents even outside the courtroom

  9. The EPO -- Like the Unified Patent Court (UPC) and Unitary Patent System -- is an Untenable Mess

The António Campinos-led EPO, nearly three weeks under his leadership, still fails to commit to justice (court rulings not obeyed), undo union-busting efforts and assure independence of judges; this, among other factors, is why the Office/Organisation and the UPC it wants to manage appear more or less doomed

  11. What Patent Lawyers Aren't Saying: Most Patent Litigation Has Become Too Risky to be Worth It

The lawyers' key to the castle is lost or misplaced; they can't quite find/obtain leverage in courts, but they don't want their clients to know that

  12. Software Patents Royalty (Tax) Campaign by IBM, a Serial Patent Bully, and the EPO's Participation in All This

The agenda of US-based patent maximalists, including patent trolls and notorious bullies from the United States, is still being served by the 'European' Patent Office, which has already outsourced some of its work (e.g. translations, PR, surveillance) to the US

  13. The European Council Needs to Check Battistelli's Back Room Deals/Back Door/Backchannel With Respect to Christian Archambeau

Worries persist that Archambeau is about to become an unworthy beneficiary (nepotism) after a Battistelli setup that put Campinos in power, supported by the Belgian delegation which is connected to Archambeau, a national/citizen of Belgium

  14. PTAB and § 101 (Section 101) Have Locked the Patent Parasites Out of the Patent System

Patent Trial and Appeal Board (PTAB) inter partes reviews (IPRs) have contributed a great deal to patent quality and have reduced the number of frivolous patent lawsuits; this means that firms which profit from patent applications and litigation hate it with a passion and still lobby to weaken if not scuttle PTAB

  15. Patents on Computer Software and Plants in the United States Indicative of Systemic Error

The never-ending expansion of patent scope has meant that patent law firms generally got their way at the patent office; can the courts react fast enough (before confidence in patents and/or public support for patents is altogether shattered)?

  16. Yesterday's Misleading News From Team UPC and Its Aspiring Management of the Unified Patent Court (UPC)

The Unified Patent Court (UPC) enthusiasts — i.e. those looking to financially gain from it — continue to wrestle with logic, manipulate words and misrepresent the law; yesterday we saw many law firms trying to make it sound as though the UPC is coming to the UK even though this isn’t possible and UPC as a whole is likely already dead

  17. Time for the European Commission to Investigate EPO Corruption Because It May be Partly or Indirectly Connected to EU-IPO, an EU Agency

The passage of the top role at the EU-IPO from António Campinos to Christian Archambeau would damage confidence in the moral integrity of the European Council; back room deals are alleged to have occurred, implicating corrupt Battistelli

  20. Alliance for US Startups and Inventors for Jobs (USIJ) Misleads the US Government, Pretending to Speak for Startups While Spreading Lies for the Patent Microcosm

In the United States, which nowadays strives to raise the patent bar, the House Small Business Committee heard from technology firms but it also heard from some questionable front groups which claim to support "startups" and "jobs" (but in reality support just patents on the face of it)

  21. 'Blockchain', 'Cloud' and Whatever Else Gets Exploited to Work Around 35 U.S.C. § 101 (or the EPC) and Patent Algorithms/Software

Looking for a quick buck or some low-quality patents (which courts would almost certainly reject), opportunists carry on with their gold rush, aided by buzzwords and hype over pretty meaningless things

  22. PTAB Defended by the EFF, the R Street Institute and CCIA as the Number of Petitions (IPRs) Continues to Grow

Patent Trial and Appeal Board (PTAB) inter partes reviews (IPRs) come to the rescue when patently-bogus patents are used, covering totally abstract concepts (like software patents do); IPRs continue to increase in number and opponents of PTAB, who conveniently cherry-pick Supreme Court (SCOTUS) decisions, can't quite stop that

  23. IAM/Joff Wild May Have Become a de Facto Media Partner of the Patent Troll iPEL

Invitation to trolls in China, courtesy of the patent trolls' lobby called "IAM"; this shows no signs of stopping and has become rather blatant

  24. Cautionary Tale: ILO Administrative Tribunal Cases (Appeals) 'Intercepted' Under António Campinos

The ILO Administrative Tribunal (ILO-AT) is advertised by the EPO's management as access to justice, but it's still being undermined quite severely to the detriment of aggrieved staff

  25. Asking the USPTO to Comply With 35 U.S.C. § 101 is Like Asking Pentagon Officials to Pursue Real, Persistent Peace

Some profit from selling weapons, whereas others profit from patent grants and litigation; what's really needed right now is patent sanity and adherence to the public interest as well as the law itself, e.g. Supreme Court (SCOTUS) decisions

  26. BT and Sonos Are Still Patent Bullies, Seeing Patents as a Backup Plan

The companies seeking to complement their business (or make up for their demise) using patents are still suing rivals while calling that litigation "research and development" (the same old euphemism)

  27. Jim Skippen, a Longtime Patent Troll, Admits That the Trolling Sector is Collapsing

Canada's biggest patent troll (WiLAN) bar BlackBerry doesn't seem to be doing too well as its CEO leaves the domain altogether

  28. From East Asia to the Eastern District of Texas: XYZ Printing, Maxell, and X2Y Attenuators

The patent aggression, which relies on improper litigation venues, harms innocent parties a great deal; only their lawyers benefit from all this mess

  29. Links 14/7/2018: Mesa 18.1.4, Elisa 0.2.1, More on Python's Guido van Rossum

    Links for the day

  30. Number of Oppositions to Grants/Awards of European Patents at the EPO Has Skyrocketed, Based on Internal Data

The number of challenged patents continues to soar and staff of the EPO (examiners already over-encumbered by far too much work, due to unrealistic targets) would struggle to cope or simply be compelled to not properly deal with oppositions
